The following are terms and condition for car rental services for your information, understanding and agreement:

Basic Term and Condition of Rental
a. Unlimited Kilometer or specified otherwise.
b. Maintenance or procure the maintenance of the vehicle in good repair condition including normal servicing and oil changed as recommended by manufacturers. Alternative car will be provided whilst performing the repair and servicing or break down.
c. Rate includes coverage of third party property damage up to RM3M and unlimited for third party death or bodily injuries.
d. C.D.W. or Collision Damage Waiver is a coverage that free hirers from financial burden for all loss or damage to the vehicle which can be incurred should hirer be unfortunate enough to be involved with an accident while driving the rented vehicle.
e. Change of booking in respect of the date, time and/or location of Pick-up and/or Return of the Rental Vehicle is allowed subject to availability of the Rental Vehicle and also subject to administrative charges as shall be determined by Magic Green Rent-A-Car Sdn. Bhd.
f. Magic Green grants registered driver(s) a limited, non-transferable and non-sub-licensable vehicle rental agreement. The vehicle is strictly for the hirer’s (or hirers’) personal use only and is prohibited from any commercial use. The vehicle may only be driven by the driver(s) registered with Magic Green.

C.D.W Exclusion:
Under the term and condition of the rental agreement, the hirer is liable for a non waiver Excess Charges specified in the rental agreement if:
a. Misuse or breach the restricted use of the vehicle or engage in any unlawful conduct.
b. Driving while under the influence of intoxicating liquor or drugs or controlled substance or driving recklessly.
c. Permit the vehicle to be driven by any unauthorised person without obtaining prior written consent from Magic Green Rent-A-Car Sdn. Bhd. office.
d. Have the car through fraud and misrepresentation.
e. Fail to promptly report any damage to the police within 24 hours (C.D.W coverage will only be effective subject to availability of police report).

Hirers are also reminded of the following:  
f. Excess charges between RM1000 to RM5000 are applicable to all damage sustained to the underbody and overhead of the vehicle.
g. All insurance howsoever is declared null and void if vehicle are driven on off roads, unsealed or unmade roads or surfaces.
h. Under the terms and condition of this rental agreement, any claims terms, as “Hit and Run” is not covered under C.D.W., neither the insurance policy.
i. Magic Green reserved the right to charge the hirer expenses such as towing and other related cost, which are not covered by the C.D.W as result of damaged to the car.

Car Accessories:
Car accessories are not included under the insurance coverage. Car accessories are specified as: Spare tires, rims tools & jack, lamps, windscreen, audio set, gear lock, lighter, wiper, switches & control button, rear view mirror and side view mirror, sun shades, cell phone holder, etc. Loss or damage of the above supplementary parts or accessories will be the responsibility of the hirer.

Excess Charges
a. Excess charges will be imposed or applied based on the following situations:
– Collisions not involving third party
– Collisions involving third party and caused by hirer’s negligence

• Collisions under the term “Hit and Run”
• Stolen or lost of vehicle during the period of renting
• Loss or damage of car accessories or any other body part of the vehicle

b. Excess charges are not applicable if collision is caused by third party and Police report is lodged within the period of 24 hours pertaining to the damages caused to the rental vehicles by accident and the accident is notified to Magic Green Rent-A-Car Sdn. Bhd. in the first place when the accident happens.

Repair:
Any necessary repairs en route will be refunded upon presentation of the damaged or replaced parts, along with the supplier’s receipt. Repairs exceeding RM50 must be approved in advance by the Magic Green Rent-A-Car Sdn. Bhd. office.

Payment:
Mode of Payment: Credit card or online banking. Payment is required immediately upon order confirmation made online or upon delivery of the vehicle. Magic Green Rent-A-Car Sdn. Bhd. accepts the following credit cards: Visa and Mastercard.

Extension of Rental:
The hirer is obligated to inform the office for any extension of rental hour and it is subjected to the car’s availability. This will enable the process for the extension of insurance coverage. Failing so, shall mean that the hirer is driving the vehicle without insurance coverage. Extension of rental hours or additional hour is chargeable at 1/12 of daily rate. Extension of car rental more than 6 hours will be charged as one day rate.

Cancellation:
Advanced cancellation notice is required or else a fee will be imposed. For non-peak season, 24 hours upfront notification is required otherwise a full day rental fee will be charged for cancellation notice received less than 24 hours. For peak season, 48 hours advanced cancellation notice is required otherwise a full day rental fee will be charged.

Fuel:
Fuel is not included in the rates. Each vehicle is supplied either with a full or half tank and shall be returned with the same quantity. Otherwise, refuelling will be provided at hirer’s expenses.

General Matters
a. All parking or toll fees including traffic offences are the responsibility of the hirers during the rental period. Hirer will be notified of any traffic offence issued by Malaysian Police or other Authority as and when such notice is sent to Magic Green Rent-A-Car Sdn. Bhd. office.

b. It is the responsibility of the hirer to settle traffic summon within 30 days from date the notice are issued. Otherwise, particulars of hirer will be forwarded to the respective authority concerned.

c. The hirer is responsible to cover their car park fees. Hirers are encouraged to download the Penang Smart Parking App for public car parks. Kindly ensure that the vehicle is parked in the designated parking space.

d. Hirer is required to purchase V.E.P.(Vehicle Entry Permit) for entry into Singapore. However, the vehicles are strictly prohibited from being driven into Thailand.

e. The hirer must be between 23 and 65 years of age and hold a valid driving licence. Driving License and Intentional Driving Permit are required to be valid in Malaysia. Foreign driving license is also valid in Malaysia for (03) month from the day of entry. Magic Green Rent-A-Car reserves the right to reject any fraud found on invalid/expired driving license or personal identification falsification on confirmed bookings placed.

Note: All non-Malaysian hirers are required to present a valid passport and a valid driving licence (original copy) upon collection of the vehicle. Failure to provide these documents will result in cancellation of the booking, and a refund will be issued accordingly.

f. Magic Green Rent-A-Car Sdn. Bhd. operates a no smoking policy for all vehicles. Smoking(including e-cigarettes) is prohibited inside the car. A penalty to hirer of RM600 will be charged for cleaning any unpleasant odour (salted fish, durian, smoking, etc.)

g. Baby seats are available upon request for a nominal fee. Such requests must be made at the time of reservation confirmation. The hirer is responsible for maintaining the cleanliness and condition of the baby seat. A penalty of RM150 will be imposed for deep cleaning if the seat is returned with unremovable stains or dirt. In the event of non-return, damage or loss of the baby seat, the hirer will be charged RM350.

h. Add on accessories such as cell phone holder, car head rest neck support, Universal Cell Phone Charging Cable and Dock are available at a charge for hirer’s convenience. All accessories are required to be refunded in good condition. A penalty to hirer of RM100 will be charged for cleaning or replacing the parts shall there be damage or lost of rented accessories.
